It is important that you read these terms & conditions carefully because your order and use of this site is subject to them.

Access and use of the website is provided by Motorcycle Turntables Ltd. (hereinafter referred to as MT) and is subject to the following terms and conditions.

These terms and conditions apply to all users of the site including casual browsers.

The use of this site constitutes your acceptance of these terms and conditions, which take effect on the date at which you first use the site. MT reserves the right to change these terms and conditions at any time by updating this.

Formation of the contract

No contract will subsist between you and MT for the sale by it to you of any product unless and until you have received confirmation of your order in the form of a receipt confirming details of your order. Once the receipt has been received, there will be a legally binding contract between us.

This site is available only for your personal, non-commercial use.

The products referred to on this site are available in the UK only. MT will not process orders for delivery to non-UK addresses.

Provision of Information

When you order any items from MT you will need to provide us with your name and address. We will use these details in accordance with our privacy policy.

You agree to provide true, accurate and complete information about yourself whenever you order any items from us.

Ordering goods

All orders placed are subject to our acceptance of the order. MT reserves the right to refuse orders.

The information contained in the site and brochure may contain technical inaccuracies or typographical errors and MT shall not be liable for any inaccuracies or errors. The reproduction of products is as accurate as photographic and printing processes permit and MT cannot accept responsibility for variances in colour and style. Every effort will be made to ensure that the reproduction is of the highest quality.

MT reserve the right to alter the specification of products as necessary and offer an equivalent or better product in the event of stock anomalies. We will use reasonable endeavours to verify the accuracy of any product or pricing information which we place on the site but we make no warranties (whether express or implied) in relation to the accuracy of such information.

MT reserve the right to make changes to the products from time to time to further improve the product quality and performance.

Full payment must be received before the manufacture of goods can start.

Deposit payments are only applicable to orders payable by finance.

Use of products

All turntables must be fixed to the ground. Motorcycle Turntables take no responsibility for fixing the turntable to the ground. Motorcycle Turntables will not be liable for any damage caused or resulting injuries from the turntable not being fixed to the ground or any damage caused whilst applying fixings to the ground.

Pricing

We reserve the right to amend any prices without any prior notice and to end any promotions at any time. We reserve the right to add or withdraw any item at any time. All prices are stated in pounds sterling. We are VAT registered and prices include VAT and are exclusive of delivery charges.

Whilst it is our intention to keep our brochure and website up to date and error free, it is the case that, on occasion, pricing errors may occur. In the event that you order an item and the price published was incorrect for any reason we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. You may then either cancel your order or confirm your order at the correct price. Prices online may differ from those in our stores.

Availability

We endeavour to indicate if an item is unavailable for any reason. In the event that you order an item, which we subsequently discover is unavailable, we will contact you and let you know when we anticipate that the item will become available. You can then decide whether to continue with your order, cancel your order (in which case we will refund any monies paid by you), or place an order for an alternative item.

Right to cancel, returns and refunds

All products supplied by Motorcycle Turntables are bespoke and made to order. Once you have placed an order, you will have a 7 day cooling off period from the date of your order. Should you wish to cancel your order during this period, you will be entitled to a full refund. If you choose to cancel your order after this cooling off period no refund will be given.

All orders must be signed for on delivery and inspection. Any defects or issues not arising from the use of the turntable must be reported in writing to sales@motorcycleturntable.com within 7 days from the date of delivery.

If you wish to return your turntable the customer is liable for the cost of the postage.

Intellectual Property

The content of the brochure and website is protected by copyright, trademarks, database and other intellectual property rights.

You may retrieve and display the content of the www.motorcycleturntable.com, store such content in electronic form on or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content of the on the MT Brochure or web site without written permission from MT. No licence is granted to you in these Terms and Conditions to use any trademark of MT. All bespoke designs remain the property of the Motorcycle Turntables.

Availability of the site

Although MT aims to offer you the best service possible, we make no promise that the services at the www.motorcycleturntable.com site will meet your requirements. We cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to Customer Services (see contact details) and we will attempt to correct the fault as soon as we reasonably can.

Your access to the MT site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.

Warranty & Liability

Subject to the conditions set out below MT warrants that the Goods will correspond with MT specification for them at the time of delivery and will be free from defects in material and workmanship for a period of twelve months. Where a valid claim in respect of any of the Goods is made pursuant to MT’s warranty, MT shall repair or at MT’s sole discretion replace the Goods (or the part in question) free of charge to the Buyer but MT shall have no further liability to the Buyer.

The above warranty is given by MT subject to the following conditions:

MT shall be under no liability in respect of any defect in the Goods arising from any drawing, design or specification supplied by the Buyer, fair wear & tear, wilful damage, negligence, abnormal working conditions, failure to follow MT’s instructions (whether oral or in writing), misuse or alteration or repair of the Goods without MT’s knowledge and or approval;

MT shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the Goods and any additional charges payable pursuant to these conditions have not been paid by the due date for payment;

MT shall be under no liability under the above warranty if the Buyer does not return the faulty or defective Goods (or the part in question) complained of to the Seller within the warranty period;

In the event an on-site visit is required to repair the Goods, MT reserve the right to charge a one way call out fee for travel to the Buyers address or the location of where the Goods is installed. Call out fees will be charged at £1.40 per mile (including VAT).

The above Warranty covers all parts, materials and labour for a period of 12 months from the date the Goods are delivered.

The Extended Warranty will waive any call out fees due and extend the warranty cover to 24 months from the date the Goods are delivered.

The Warranty or Extended Warranty is not transferrable.

Furthermore, the inclusion of any links to other such websites does not mean that MT endorses or otherwise approves any information or material contained in those sites, MT is neither responsible nor liable for your use of other websites which you may access via links within this site. Links to this website may not be included in any other website without the prior written permission of MT.

Liability

This is as follows: –
a) If the goods MT delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, MT shall have no liability to you unless you notify MT in writing at MT contact address of the problem within 10 working days of the delivery of goods in question.
b) If you notify a problem to MT under this condition, MT only obligation will be, at its option:- to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question in whatever way MT chooses.
c) MT will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to MT under this condition and MT shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (b) above.
d) Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit MT liability to you for any death or personal injury resulting from its negligence. Nothing in this agreement is intended to limit any rights you may have as a consumer under any applicable law that may not be legally excluded.

Validity

If any term, condition, or provision of these Terms and Conditions is determined to be unlawful, invalid, void, or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby.

Force majeure

MT will not be liable to you in the event that it is prevented by circumstances beyond its control from delivering any product which you have ordered or for any damaged or defective goods.

Governing law

Any contract between us will be interpreted, construed and interpreted in all respects in accordance with the laws of England and any dispute in relation to such contract shall be subject to the exclusive jurisdiction of the English Courts.

Entire agreement

These Terms and Conditions, together with the current MT brochure and website prices, delivery details and MT contact details, set out the whole of our agreement relating to the supply of the goods to you by MT.

These Terms and Conditions cannot be varied except in writing signed by a director of MT. In particular nothing said by any sales person on behalf of MT should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods offered for sale by MT shall have no liability for any such representation being untrue or misleading.

Conditions of Use

Your use of this site and the information available on this site is subject to the terms and conditions. Please read these carefully before using the site as by using this site you are acknowledging your consent to them.

You agree that you will only use our web site in a way which is consistent with our terms and conditions and which complies with applicable laws and regulations.
